Terms of service

SECTION 1 — ELIGIBILITY AND ACCESS

You may use the public portions of the Services for lawful, personal, informational, educational, and noncommercial purposes.

By using the Services, you represent that:

  1. you are legally capable of entering into these Terms;
  2. the information you provide is accurate, current, and complete;
  3. you will use the Services only for lawful purposes; and
  4. you will comply with all applicable program rules and eligibility requirements.

Certain portions of the Services may be directed toward or may collect information regarding individuals under 18 years of age, including prospective nominees, applicants, honorees, participants, or award recipients.

A parent, legal guardian, teacher, school representative, counselor, mentor, nominator, or other authorized adult who submits information concerning a minor represents that they:

  • are authorized to provide the submitted information;
  • have obtained any consent required from the minor’s parent or legal guardian;
  • have provided accurate information;
  • understand how the information may be used in connection with the FEFA program; and
  • will provide any additional consent, authorization, verification, or release reasonably requested by FEFA Foundation.

Submission of a nomination does not create an account, contractual relationship, employment relationship, fiduciary relationship, or entitlement to receive an award or other benefit.

SECTION 2 — ACCOUNTS AND WEBSITE SECURITY

Certain Services may require you to create an account or provide an email address, password, verification code, or other credentials.

You are responsible for:

  • maintaining the confidentiality of your credentials;
  • restricting access to your account and devices;
  • ensuring that account information remains current;
  • notifying us promptly of suspected unauthorized access; and
  • all activity conducted through your account.

You may not transfer, sell, assign, share, or license your account to another person without our written permission.

We may suspend or disable an account if we reasonably believe it has been compromised, used improperly, or used in violation of these Terms.

SECTION 3 — FEFA AWARDS, NOMINATIONS, AND APPLICATIONS

FEFA Foundation may accept nominations or applications for recognition, awards, scholarships, mentorship opportunities, educational opportunities, events, or other programs.

Each program may be subject to additional rules concerning:

  • eligibility;
  • age or grade level;
  • geographic location;
  • school enrollment;
  • academic standing;
  • community service;
  • leadership experience;
  • application deadlines;
  • required documentation;
  • recommendations;
  • parental or guardian consent;
  • interviews;
  • attendance at an event;
  • publicity permissions; and
  • selection criteria.

Program-specific rules, instructions, and eligibility requirements are incorporated into these Terms by reference.

3.1 No Guarantee of Selection

Submitting a nomination or application does not guarantee that the nominee or applicant will:

  • be determined eligible;
  • advance to a later stage;
  • receive an interview;
  • become a finalist;
  • receive an award;
  • receive a scholarship or financial benefit;
  • participate in mentorship or educational programming; or
  • be featured by FEFA Foundation.

FEFA Foundation may determine eligibility, finalists, recipients, and honorees in its reasonable discretion, subject to any published program rules.

3.2 Accuracy of Submissions

The person submitting a nomination, application, recommendation, biography, essay, photograph, academic record, or supporting material represents that the submission is accurate and not intentionally misleading.

FEFA Foundation may request verification, including documentation from a school, parent, guardian, community organization, nominator, reference, or other source.

We may reject or disqualify a submission that is:

  • incomplete;
  • late;
  • inaccurate;
  • misleading;
  • fraudulent;
  • submitted without proper authorization;
  • inconsistent with program eligibility requirements; or
  • otherwise contrary to the purpose or integrity of the FEFA program.

3.3 Changes to Programs

FEFA Foundation may modify program dates, deadlines, criteria, award categories, event details, selection procedures, or benefits when reasonably necessary.

Where practical, material changes will be communicated through the website or to affected participants using the contact information provided.

SECTION 4 — SUBMITTED MATERIALS

You may submit materials such as:

  • nominations;
  • applications;
  • essays;
  • biographies;
  • recommendations;
  • photographs;
  • videos;
  • academic or extracurricular information;
  • community-service information;
  • testimonials;
  • event registrations;
  • messages; and
  • other supporting documents.

Collectively, these are referred to as “Submitted Materials.”

You retain ownership of Submitted Materials that you own. However, by submitting materials to FEFA Foundation, you grant FEFA Foundation a nonexclusive, worldwide, royalty-free license to receive, store, reproduce, review, evaluate, format, and internally share those materials as reasonably necessary to:

  • administer a nomination or application;
  • determine eligibility;
  • select finalists, honorees, or recipients;
  • communicate with nominees, applicants, families, schools, and references;
  • administer events and programs;
  • maintain appropriate program records;
  • protect the integrity and security of the program; and
  • comply with legal obligations.

Public use of a nominee’s or participant’s name, likeness, image, story, biography, photograph, video, or testimonial will be subject to any additional consent, publicity release, parent or guardian authorization, or program terms required by FEFA Foundation or applicable law.

You represent that you have the right to submit the materials and that doing so does not violate the rights of another person.

Do not submit confidential information, medical information, Social Security numbers, financial-account information, or other highly sensitive information unless FEFA Foundation specifically requests it through an authorized and secure process.

SECTION 5 — PARENTAL AND GUARDIAN CONSENT

FEFA Foundation is committed to respecting the privacy and safety of young participants.

Where a nominee, applicant, honoree, attendee, or program participant is a minor, FEFA Foundation may require consent from a parent or legal guardian before the individual may:

  • complete an application;
  • attend an event;
  • participate in an interview;
  • participate in mentorship or educational programming;
  • receive an award;
  • travel in connection with a program;
  • be photographed or recorded;
  • have their name or story published; or
  • participate in another FEFA activity.

FEFA Foundation may decline or discontinue a minor’s participation if required consent or documentation is not provided.

Parents and guardians are responsible for reviewing program details, event requirements, supervision arrangements, transportation obligations, and applicable releases before authorizing participation.

SECTION 6 — EVENTS AND PROGRAM PARTICIPATION

FEFA Foundation may organize or participate in awards ceremonies, educational programs, mentorship activities, community events, workshops, fundraising events, and related activities.

Event registration or selection does not guarantee admission if capacity, safety, eligibility, payment, documentation, or other requirements have not been satisfied.

Participants and guests must:

  • follow event rules and venue requirements;
  • behave respectfully toward participants, staff, volunteers, speakers, and guests;
  • comply with safety instructions;
  • avoid disruptive, threatening, discriminatory, or unlawful conduct; and
  • comply with applicable laws and policies.

FEFA Foundation may deny entry to or remove an individual whose conduct threatens safety, disrupts an event, violates these Terms, or is inconsistent with the mission and values of FEFA Foundation.

Event dates, speakers, venues, schedules, programming, and formats may change. An event may be postponed, relocated, converted to a virtual format, or canceled because of circumstances outside our reasonable control.

Unless expressly stated otherwise, participants are responsible for their own transportation, lodging, meals, supervision, and related expenses.

SECTION 7 — MENTORSHIP AND EDUCATIONAL INFORMATION

FEFA Foundation may provide mentorship, educational materials, workshops, presentations, resource links, or general guidance.

These Services are intended for general educational and informational purposes. They do not constitute:

  • legal advice;
  • medical or mental-health advice;
  • financial advice;
  • professional counseling;
  • academic guarantees;
  • admissions advice;
  • employment guarantees; or
  • a promise of any particular personal, educational, or professional outcome.

Participants should consult a qualified professional when individualized professional advice is required.

Unless expressly stated in writing, participation in an FEFA program does not create an employment, agency, fiduciary, therapeutic, attorney-client, or formal academic-advisor relationship.

SECTION 8 — DONATIONS, SPONSORSHIPS, AND PAYMENTS

FEFA Foundation may make donation, sponsorship, event-registration, fundraising, merchandise, or other payment options available through the Services.

You agree to provide accurate and complete billing and payment information and represent that you are authorized to use the payment method submitted.

8.1 Donations

Unless expressly stated otherwise, donations are voluntary and are not payments for goods or services.

FEFA Foundation does not guarantee that any payment will be tax-deductible. The deductibility of a contribution depends on applicable law, FEFA Foundation’s tax status, the nature of the payment, and the donor’s individual circumstances.

Donors should consult their own tax advisers regarding deductibility.

The website should not be interpreted as representing that FEFA Foundation is a tax-exempt charitable organization unless that status has been formally granted and is accurately disclosed on the website.

8.2 Restricted Contributions

A donor may express a preference that a contribution support a particular program or purpose. Unless FEFA Foundation expressly accepts a legally binding restriction in writing, all contributions may be used in furtherance of FEFA Foundation’s mission and operational needs.

If a designated program becomes impractical, impossible, fully funded, or inconsistent with legal requirements, FEFA Foundation may redirect the funds to a substantially similar purpose, to the extent permitted by law.

8.3 Refunds

Donations and sponsorship payments are generally nonrefundable except where:

  • required by law;
  • a duplicate payment was made;
  • an unauthorized transaction is verified;
  • an event-specific refund policy applies; or
  • FEFA Foundation approves a refund in its discretion.

Requests should be submitted promptly to manuel@fefafoundation.com.

Registration fees, merchandise purchases, and other transactions, where offered, may be governed by additional refund, cancellation, fulfillment, or shipping terms displayed at the time of payment.

8.4 Payment Processing

Payments may be processed by Shopify Payments, PayPal, Stripe, or another third-party payment processor. FEFA Foundation may not directly receive or retain complete payment-card information.

Your use of a third-party payment service is also subject to that provider’s applicable terms and privacy practices.

SECTION 9 — SPONSORS, PARTNERS, AND THIRD-PARTY OPPORTUNITIES

FEFA Foundation may acknowledge sponsors, donors, educational institutions, community organizations, vendors, speakers, volunteers, mentors, and other partners.

Reference to a third party does not necessarily constitute an endorsement, guarantee, agency relationship, partnership, or joint venture.

Any scholarship, internship, employment, mentorship, product, service, or opportunity offered directly by a third party is governed by the third party’s terms. FEFA Foundation is not responsible for a third party’s independent decisions, services, conduct, or representations.

SECTION 10 — INTELLECTUAL PROPERTY

The Services and their contents, including FEFA Foundation’s:

  • names;
  • logos;
  • seals;
  • trademarks;
  • award names;
  • graphics;
  • designs;
  • photographs;
  • videos;
  • text;
  • program materials;
  • educational content;
  • event materials;
  • website layout; and
  • selection and arrangement of content

are owned by or licensed to FEFA Foundation and are protected by applicable copyright, trademark, and other intellectual-property laws.

These Terms permit you to access and use the Services for personal, lawful, and noncommercial purposes.

Without prior written permission, you may not:

  • reproduce or distribute substantial portions of the website;
  • modify or create derivative works from FEFA materials;
  • use FEFA names, logos, seals, or marks;
  • imply endorsement, sponsorship, or affiliation;
  • publicly display or perform protected materials;
  • republish website content;
  • sell or commercially exploit FEFA content;
  • use FEFA materials to train or develop an artificial-intelligence system; or
  • remove copyright, trademark, attribution, or proprietary notices.

Limited sharing of publicly available website links or program announcements for informational and noncommercial purposes is permitted, provided the content is not altered and FEFA Foundation is accurately identified.

All rights not expressly granted are reserved.

SECTION 11 — PUBLICITY AND MEDIA

FEFA Foundation may photograph, film, livestream, or otherwise record public or registered events.

Where legally required, FEFA Foundation will obtain appropriate consent or a release before using an identifiable participant’s image, voice, story, or likeness for promotional purposes.

Separate consent may be required for minors.

Event attendees may appear incidentally in crowd photographs, background footage, or recordings of public-facing activities. Any event-specific photography or recording notice will supplement these Terms.

You may not use photographs, recordings, names, biographies, or personal stories of nominees, honorees, minors, attendees, staff members, or volunteers for commercial, misleading, harassing, exploitative, or unlawful purposes.

SECTION 12 — VOLUNTEERS, MENTORS, AND CONTRIBUTORS

FEFA Foundation may engage volunteers, mentors, reviewers, judges, speakers, committee members, or other contributors.

Participation in such a role may be subject to additional requirements, including:

  • an application;
  • screening;
  • references;
  • background checks;
  • confidentiality obligations;
  • youth-protection requirements;
  • conflict-of-interest disclosures;
  • training;
  • codes of conduct; and
  • separate written agreements.

Submitting an interest form does not guarantee acceptance into any volunteer, mentor, judging, or advisory role.

Unless otherwise agreed in writing, volunteer participation does not create an employment relationship or entitlement to wages, benefits, or reimbursement.

SECTION 13 — FEEDBACK AND TESTIMONIALS

If you voluntarily submit an idea, suggestion, comment, testimonial, review, proposal, or other feedback concerning FEFA Foundation or the Services, you grant FEFA Foundation a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that feedback for operational, educational, fundraising, and promotional purposes.

We will seek any additional consent required before publicly identifying a minor or publishing protected personal information.

You represent that:

  • the feedback is truthful;
  • you have the right to submit it;
  • it does not violate another person’s rights;
  • it does not contain unlawful, defamatory, abusive, or malicious material; and
  • any material relationship, incentive, or compensation connected to the feedback has been disclosed.

FEFA Foundation is not obligated to use, compensate you for, keep confidential, or respond to voluntarily submitted feedback.

SECTION 14 — THIRD-PARTY TOOLS AND LINKS

The Services may include links to or integrations with third-party websites, forms, social-media platforms, video services, event services, payment processors, email services, mapping services, or other tools.

FEFA Foundation does not control all third-party services and does not guarantee their availability, accuracy, security, accessibility, or practices.

When you access a third-party service, you do so at your own discretion and are subject to that third party’s terms and privacy policy.

Questions or complaints concerning a third-party product or service should be directed to the applicable provider.

SECTION 15 — RELATIONSHIP WITH SHOPIFY

FEFA Foundation’s website is powered by Shopify, which enables us to provide portions of the Services.

Any donation, registration, purchase, application, nomination, or other interaction you make through the FEFA Foundation website is made directly with or submitted directly to FEFA Foundation, unless clearly stated otherwise.

Shopify is not responsible for:

  • FEFA Foundation’s awards or selection decisions;
  • nominations or applications;
  • program eligibility;
  • events;
  • mentorship activities;
  • educational information;
  • charitable representations;
  • donations or sponsorships;
  • fulfillment of FEFA obligations; or
  • any injury, loss, claim, or damage arising from FEFA Foundation’s activities.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising from your direct dealings with FEFA Foundation.

SECTION 16 — PRIVACY

Personal information collected through the Services is governed by our Privacy Policy, available at:

Certain information may also be processed by Shopify and other service providers under their respective privacy policies.

Because Shopify hosts the website, Shopify may collect and process information concerning your access to and use of the Services to provide, secure, maintain, and improve its platform.

Information submitted through the Services may be shared with service providers, program administrators, reviewers, judges, event vendors, schools, references, payment processors, or other parties when reasonably necessary to administer FEFA Foundation’s programs, subject to our Privacy Policy and applicable law.

Information may be processed in jurisdictions outside the state or country in which you reside.

Do not submit information concerning another person unless you are authorized to do so.

SECTION 17 — ERRORS, CHANGES, AND AVAILABILITY

The website may occasionally contain typographical errors, outdated information, technical errors, broken links, inaccuracies, or omissions.

These may concern:

  • program descriptions;
  • eligibility requirements;
  • deadlines;
  • dates;
  • event locations;
  • speaker information;
  • awards;
  • donation information;
  • sponsorship opportunities;
  • availability; or
  • other Services.

FEFA Foundation may correct errors and update information at any time.

We do not guarantee that all Services, applications, events, resources, or features will always be available. We may modify, suspend, or discontinue any portion of the Services when reasonably necessary.

SECTION 18 — PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to:

  1. violate any applicable law or regulation;
  2. submit a fraudulent nomination, application, recommendation, donation, or registration;
  3. impersonate another person or misrepresent your identity or authority;
  4. submit information concerning a minor without appropriate authorization;
  5. harass, threaten, exploit, intimidate, or harm another person;
  6. discriminate against another person unlawfully;
  7. infringe intellectual-property, privacy, publicity, or other legal rights;
  8. upload viruses, malicious code, or harmful files;
  9. interfere with website security or operation;
  10. bypass access controls or eligibility requirements;
  11. collect personal information about nominees, minors, participants, or other users;
  12. scrape, harvest, extract, or compile website information through automated means without permission;
  13. use bots or automated systems to submit nominations, applications, registrations, or messages;
  14. send spam, phishing communications, chain letters, or unauthorized promotions;
  15. falsely claim affiliation with, sponsorship by, or endorsement from FEFA Foundation;
  16. exploit FEFA Foundation’s name, logo, honorees, participants, or programs for unauthorized commercial purposes;
  17. use website content or Submitted Materials to train, test, or develop artificial-intelligence systems without written authorization; or
  18. engage in conduct that may harm FEFA Foundation, Shopify, program participants, or other users.

We may restrict, suspend, or terminate access when we reasonably believe these Terms have been violated.

SECTION 19 — CONFIDENTIALITY OF PROGRAM INFORMATION

Certain information concerning applicants, nominees, minors, reviewers, judges, references, selection deliberations, or internal program operations may be confidential.

Receiving access to such information does not authorize you to publish, distribute, retain, or use it for an unrelated purpose.

Reviewers, judges, volunteers, mentors, committee members, vendors, and program participants may be required to sign separate confidentiality or data-protection agreements.

FEFA Foundation is not required to disclose:

  • confidential nominations;
  • private application materials;
  • internal scoring;
  • reviewer identities;
  • judging deliberations;
  • internal communications;
  • legally protected records; or
  • information concerning another applicant or participant.

SECTION 20 — DISCLAIMER OF WARRANTIES

The Services and website content are provided for general informational, educational, program-administration, and community-engagement purposes.

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis, without warranties or conditions of any kind, express or implied.

FEFA Foundation does not warrant that:

  • the Services will always be available, uninterrupted, secure, or error-free;
  • website information will always be complete or current;
  • every nomination or application will be reviewed in a particular manner;
  • participation will produce a specific educational, personal, or professional result;
  • an applicant will receive an award or opportunity;
  • external links or third-party services will remain available; or
  • defects will always be corrected immediately.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

SECTION 21 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, FEFA Foundation and its directors, officers, employees, volunteers, committee members, judges, reviewers, mentors, contractors, sponsors, affiliates, agents, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to:

  • your use of or inability to use the Services;
  • a nomination or application;
  • an eligibility or selection decision;
  • participation in or inability to participate in a program;
  • an event change, postponement, or cancellation;
  • reliance on educational or informational content;
  • unauthorized access to information despite reasonable safeguards;
  • third-party tools, services, links, or conduct;
  • loss of data, opportunity, goodwill, or anticipated benefit; or
  • any other matter connected to the Services.

This limitation applies regardless of the legal theory asserted and even if the possibility of damages was known.

Nothing in these Terms limits liability that cannot legally be limited, including liability arising from intentional misconduct or other matters for which exclusion is prohibited by law.

SECTION 22 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify, defend, and hold harmless FEFA Foundation, Shopify, and their respective affiliates, officers, directors, employees, volunteers, agents, contractors, licensors, and service providers from third-party claims, liabilities, losses, damages, judgments, costs, and reasonable attorneys’ fees arising from:

  1. your material violation of these Terms;
  2. your unlawful use of the Services;
  3. information or materials you submit;
  4. your violation of another person’s rights;
  5. a submission made without proper authorization; or
  6. your fraud, willful misconduct, or negligent conduct.

FEFA Foundation will provide reasonable notice of an indemnifiable claim. Failure to provide prompt notice will relieve you of your obligations only to the extent the delay materially prejudices your ability to defend the claim.

SECTION 23 — SUSPENSION AND TERMINATION

FEFA Foundation may suspend or terminate your access to all or part of the Services if:

  • you violate these Terms;
  • you threaten the safety or rights of another person;
  • you interfere with the operation or integrity of a program;
  • you submit fraudulent or unauthorized information;
  • continued access may expose FEFA Foundation or another person to legal or security risk; or
  • suspension or termination is otherwise reasonably necessary.

Termination does not affect obligations or rights that arose before termination.

Sections concerning intellectual property, Submitted Materials, confidentiality, disclaimers, limitations of liability, indemnification, governing law, and other provisions that by their nature should survive will remain effective.

SECTION 24 — SEVERABILITY

If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The unenforceable portion will be considered severed, and the remaining provisions will remain in effect.

SECTION 25 — WAIVER AND ENTIRE AGREEMENT

Failure by FEFA Foundation to enforce a provision of these Terms does not waive the right to enforce that provision later.

These Terms, the Privacy Policy, program-specific rules, releases, consent forms, and other policies expressly incorporated by reference constitute the entire agreement concerning your use of the Services.

Program-specific terms will control if they directly conflict with these general Terms concerning that particular program.

SECTION 26 — ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without FEFA Foundation’s prior written consent.

FEFA Foundation may assign or transfer these Terms as part of a reorganization, merger, transfer of operations, or other lawful transaction, subject to applicable law.

SECTION 27 — GOVERNING LAW AND VENUE

These Terms and any dispute arising from or relating to the Services will be governed by the laws of the State of [INSERT STATE], without regard to its conflict-of-laws principles.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms.
